Iowa imposes harsh punishments for marijuana-related drug charges. Possession of any amount is illegal and may incur heavy fines and even jail time.
Iowa currently permits medical marijuana use only for patients with qualifying conditions and access cannabis products with THC content of less than 3% through its program.
Medical Marijuana
Iowa law recognizes medical marijuana for those who meet its qualifications, making its use an effective tool in treating debilitating conditions and relieving pain and discomfort. Patients using cannabis as medicine can reduce opioid dosage while experiencing less overall discomfort and lessening pain relief.
Iowa law permits certified medical marijuana patients to purchase various cannabis products such as capsules, tinctures, lotions and vaporizable oils; however, smoking of marijuana remains illegal and recreational use still unlawful. Any cultivation or distribution of marijuana in Iowa is against the law with penalties including up to six months imprisonment and a $1,000 fine; further convictions carry more severe punishment.
Iowa residents seeking medical marijuana must first have their health care provider sign an application. You can complete it online for $100 fee with possible discounts available depending on financial hardship. If they want to use marijuana at work, however, they must inform their employer and provide results from a drug test prior to using any products containing medical cannabis.
Recreational Marijuana
Iowa does not yet permit recreational marijuana sales, however. Iowa offers a limited medical marijuana program which permits up to five state-licensed dispensaries to sell non-smokable creams, oils, capsules and vaporizers to patients suffering from certain medical ailments.

Bolkcom’s bill would impose a 10% tax on commercial cannabis sales that would be distributed between state agencies responsible for alcohol laws, schools and mental health services and local law enforcement agencies. It would also decriminalize possession of small amounts of marijuana among adults while permitting municipalities to decide whether retail sales will take place or not. Since Iowa lacks a citizen initiative process, changes to law are implemented through an act of the legislature or constitutional amendment approved by voters.
CBD Products
Iowa CBD products are legal to buy and possess, provided that their delta-9 THC concentration does not exceed 0.3% by dry weight. Customers may purchase CBD online or in store – purchasing online provides customers with more choices and may save them money.
The 2018 Farm Bill legalized hemp with 0.3% THC or less from being listed as a controlled substance and made it federally legal, but this did not alter state laws which continue to prohibit smoking marijuana and purchasing high-THC CBD products in Iowa. Delta-8 THC
Delta-8 THC, or hemp-derived THC, cannot legally be purchase or possess in Iowa due to state laws that equate it with Marijuana. Furthermore, Iowa restricts THC concentration in hemp to 0.3% or lower; as such it is imperative that any product containing Delta 8 comes from online stores with third-party lab tests and full ingredient lists available before being purchase.
